Under the National Employment Standards (NES), the minimum notice period depends on your years of continuous service: less than 1 year = 1 week, 1–3 years = 2 weeks, 3–5 years = 3 weeks, 5+ years = 4 weeks. Employees aged 45+ with at least 2 years of service get an extra week.
Yes. If you are over 45 years old and have completed at least 2 years of continuous service with your employer, you are entitled to one additional week of notice on top of the standard NES minimum.
Yes. Your employer can choose to pay you in lieu of notice (PILON) instead of requiring you to work the notice period. The payment must equal what you would have earned during the notice period.
Notice pay and redundancy pay are separate entitlements. You are entitled to both your notice period (or payment in lieu) AND your redundancy pay if you are made redundant.
Your employment contract can provide for a longer notice period than the NES minimum, and that longer period applies. However, the contract cannot provide less than the NES minimum.
